By accessing and using EvalPro ("the Platform"), you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you may not use the Platform.
1. License & Use. EvalPro grants authorized users a limited, non-exclusive, non-transferable license to use the Platform for legitimate educator evaluation purposes within their organization. Users may not copy, modify, distribute, reverse engineer, or create derivative works based on the Platform.
2. AI-Generated Content. Feedback generated by EvalPro's AI is intended as a professional starting point. All AI-generated content must be reviewed, edited, and approved by a qualified evaluator before distribution. Users are solely responsible for the accuracy and appropriateness of all feedback shared with educators.
3. Data Privacy. EvalPro collects and processes educator evaluation data. All data is encrypted in transit and at rest. User data is not sold to third parties. Data is retained in accordance with applicable education records laws.
4. User Accounts. Users are responsible for maintaining the confidentiality of their login credentials. Administrators are responsible for managing user access within their organization.
5. FERPA Compliance. Users must comply with the Family Educational Rights and Privacy Act (FERPA) and all applicable state laws regarding educator evaluation records.
6. Intellectual Property. EvalPro and all associated content, features, and functionality are owned by Bekin and protected by copyright, trademark, and other intellectual property laws.
7. Limitation of Liability. EvalPro is provided "as is" without warranties of any kind. Bekin shall not be liable for any indirect, incidental, or consequential damages arising from use of the Platform.

Privacy Policy

Data We Collect: User account information (name, email, role), classroom observation notes and feedback, evaluation records and ratings, professional goals and progress notes.
How We Use Data: To provide the evaluation platform services, to generate AI-powered feedback, to produce evaluation reports, and to facilitate communication between evaluators and educators.
Data Security: All data is encrypted in transit (TLS) and at rest. Access is controlled through role-based permissions. We use Supabase for secure database hosting with SOC 2 compliance.
Data Sharing: We do not sell user data. Data may be shared with AI providers (Anthropic) for feedback generation — only observation notes are sent, not personally identifiable student information.
Data Retention: Evaluation records are retained for the duration required by Massachusetts education regulations. Users may request data deletion by contacting their administrator.
