These Terms of Service (“Terms”) govern your use of EvalPro, a web-based educator evaluation platform operated by Bekin (“we,” “our,” or “us”). By accessing or using EvalPro, you agree to be bound by these Terms.
1. Permitted Use
EvalPro is provided exclusively for use by authorized school districts and their staff under a written agreement or license with Bekin. Unauthorized use, sharing of credentials, or access by non-authorized parties is prohibited.
2. User Accounts
You are responsible for maintaining the confidentiality of your login credentials. District administrators are responsible for provisioning and deprovisioning staff accounts in a timely manner. You must notify your administrator immediately if you suspect unauthorized access to your account.
3. Data Ownership
All educator records, evaluation data, and student information entered into EvalPro remain the property of the applicable school district. Bekin processes this data solely to provide and improve the platform services under the terms of any applicable Data Processing Agreement.
4. Acceptable Use
You agree not to:
- Use the platform for any unlawful purpose or in violation of applicable education laws (including FERPA)
- Attempt to access data belonging to another district or user
- Reverse-engineer, decompile, or copy any portion of the platform
- Transmit malicious code or attempt to disrupt platform availability
5. Confidentiality
Evaluation records, observation notes, and other educator performance data contained in EvalPro are confidential personnel records. Access is limited to authorized district personnel with a legitimate educational interest, consistent with applicable law.
6. Availability and Uptime
We strive to maintain high availability of the platform. Planned maintenance windows are communicated in advance when possible. We are not liable for service interruptions outside of agreed SLA terms.
7. Limitation of Liability
To the maximum extent permitted by law, Bekin shall not be liable for indirect, incidental, or consequential damages arising from your use of EvalPro. Our total liability shall not exceed the fees paid by your district in the preceding twelve months.
8. Modifications
We may update these Terms from time to time. Continued use of EvalPro after changes are posted constitutes acceptance of the updated Terms. District administrators will be notified of material changes.
